The slaughter performed by the Magians is unlawful. This ruling is stated by Ahmad and supported by the general body of scholars. The prohibition stems from the general rule that the ruling of the People of the Book regarding exceptions does not apply to them, especially since it is not established that they possess a divine book. If the presumption of prohibition is favored regarding their blood (i.e., their lives are protected due to a semblance of possessing a book), then favoring the definitive prohibition concerning their slaughter and women is more appropriate.

Abu Thawr permitted it, analogizing their ruling to that of the People of the Book because they pay the Jizyah. However, the defense for protecting their lives based on the semblance of a book must lead to favoring the prohibition of their slaughter and women, as the prohibition derived from clearer evidence outweighs the semblance that grants concession.
