What is the ruling if misrepresentation (Ghurur) occurred from the slave herself regarding her status?
General Chapter
Al-Mughni
Book of Marriage
Primary text
If the misrepresentation originated from the slave herself, she receives nothing, as imposing an obligation on her that she would subsequently use to claim indemnity against herself is of no benefit.
Supporting text
If the misrepresentation originated from someone other than the slave, that party must compensate her for the loss, and they have the right to seek recourse against the one who actually misrepresented.
