If the husband is one to whom marriage to female slaves is impermissible, the contract is fundamentally invalid, and no Mahr is due before consummation.

Supporting text

If consummation occurs in such an invalid marriage, the husband is liable for the Mahr. There are two narrations regarding whether this liability is for the stipulated amount or the customary dower (Mahr al-Mithl).
