What is the status of the marriage if the husband revokes the revocable divorce while the wife has the option to annul, and she exercises that option?
Chapter on Marriage of Polytheists
Al-Mughni
Book of Marriage
Primary text
If the husband revokes the divorce, the wife retains the right to seek annulment. If she annuls the marriage, and the husband subsequently remarries her, the marriage stands valid based on one divorce count because the slave's (husband's) divorce counted as two (out of the three available to a free man).
Supporting text
If the husband frees himself before remarrying her after the annulment, the marriage is based on two divorces because he has become a free man and possesses the full three divorce options like other free men.
