What are the consequences if a Mukatab travels despite a valid stipulation against it?
General Chapter
Al-Mughni
Book of Mukātaba (Contractual Manumission)
Primary text
If the slave travels without permission and it is possible to return him, the master may do so. If it is not possible to return him, there are two possibilities: the master may declare him incapable and return him to slavery because he did not fulfill the stipulation, similar to failing to fulfill the payment of Mukatabah.
Supporting text
Alternatively, the master may not possess this right because the slave has a valid Mukatabah and has not shown incapacity, so the master cannot declare him incapable, just as if there were no stipulation.
