Is it permissible for a master to sell an item on credit (nasi'ah)?
General Chapter
Al-Mughni
Book of Mukātaba (Contractual Manumission)
Primary text
It is not permissible for the master to sell an item on credit, even if the sale price is multiple times its actual value. This is the position of Al-Shafi'i because such a transaction involves deception (taghrir) concerning wealth, which is prohibited due to the right the master holds over the wealth. This prohibition remains whether the master takes a guarantor, a pledge (rahn), or nothing for the deferred payment because the element of risk (gharar) is not removed, as the pledge might be destroyed, or the debtor and the guarantor might become bankrupt.
Supporting text
A view attributed to Al-Qadi suggests that permissibility can be derived, following the ruling concerning a gambler (dharib), implying that the sale on credit might be permissible in one narration, and this analogy should apply here.
