Book of Mukātaba (Contractual Manumission)
Primary text
If they enter under Aman and wish to return to Dar al-Harb, they are not prevented. If the master wishes to return and take the Mukatab with him, and the Mukatab refuses, the master cannot compel him, because by the contract of indenture, the master's ownership and authority over him have ceased, leaving only a debt obligation upon the Mukatab. One who is owed a right by another is not entitled to compel the other to travel for the sake of settling that debt. The master is advised: if you wish to reside in Dar al-Islam to collect the installments of the indenture money, establish a guarantee of protection (Dhimma) and remain; if the period is long, appoint an agent to collect the installments. Upon fulfilling the installments, the Mukatab is freed, and he has the choice to remain in Dar al-Islam under Dhimma or return without prohibition.
