Who has the right to the slave's property if there is a dispute between the confirming and denying heirs?
General Chapter
Al-Mughni
Book of Mukātaba (Contractual Manumission)
Primary text
If the denying heir claims the property was in the slave's possession before the claim of Mukatabah and was earned during their father's lifetime, while the confirming heir denies this, the statement of the confirming heir is accepted with his oath. This is because the denying heir claims earnings at a time when the default is their absence, and if the slave and Mukatab disputed this matter, the statement of the Mukatab would be accepted, so likewise for one who stands in his place.
