What is the ruling concerning assets purchased by the Mukatab with the funds, if the assets remain in his possession when he becomes unable to pay?
General Chapter
Al-Mughni
Book of Mukātaba (Contractual Manumission)
Primary text
If the Mukatab purchased assets with the funds and then became unable to pay while those assets remained in his possession, the legal dispute concerning them mirrors the dispute regarding the original funds themselves. This is because the assets are considered the substitute (*'iwad*) for the funds and stand in their place.
Supporting text
This situation is analogous to a warrior (*ghazi*) receiving from charity the funds to purchase a horse and armament, and then having those items remaining in excess of his needs.
