This bequest is valid if the default occurs during the testator's lifetime. If the default occurs after the testator's death, the legatee does not acquire the right because the condition becomes void upon the testator's death, similar to the case where a master says to his slave: 'If you enter the house, you are free after my death,' and the slave does not enter before the master dies.
