What is the legal consequence if the wife dies before the *li'an* is enacted?
General Chapter
Al-Mughni
Book of Mutual Imprecation (Li'an)
Primary text
If the wife dies before the *li'an*, she dies while still legally married to the husband, and he inherits from her, according to the view of the majority of scholars. The basis for this is that she died in the state of marriage. Furthermore, *li'an* is a cause for separation, and since separation is not established after her death, it does not preclude inheritance, similar to how divorce does not preclude inheritance if it occurs after the husband's death.
Supporting text
A narration from Ibn Abbas, along with similar reports from Al-Sha'bi and 'Ikrimah, states that if the husband pronounces *li'an*, he does not inherit, based on the premise that *li'an* establishes a separation that negates inheritance, just as if it had been performed during her lifetime.
