Is a slave woman purchased by her denouncing husband permissible for him to possess?
General Chapter
Al-Mughni
Book of Mutual Imprecation (Li'an)
Primary text
If a man pronounces the *li'an* (mutual imprecation) against his wife and then purchases her, she remains impermissible to him. This ruling aligns with the position of Al-Shafi'i. The prohibition is considered permanent, making her forbidden to the purchaser, similar to a prohibition established by suckling (*rada'ah*). Furthermore, a man who divorces his wife three times cannot lawfully remarry her without an intervening marriage and consummation; thus, in this case of perpetual prohibition, it is even more stringent. Moreover, the prohibition resulting from triple divorce pertains specifically to marriage, whereas this prohibition is not so restricted.
