Book of the Oath of Abstention (Ila')

Book 41 · Issue 4 · Bab 1

Open in Qurani

Primary text

If the husband has intercourse with one of the wives during the established waiting period (*Waqf*) or prior to it, his oath is dissolved, and the ruling of Ila' is dropped for the remaining wives, according to the primary opinion. This is because the oath has been fulfilled concerning that one wife.

Supporting text

Under the opinion of Al-Qadi and his supporters, if he has intercourse with one wife, he must still wait for the remainder, similar to the situation where he divorces the wife for whom the waiting period was established.
