What happens to the Ila' if the husband divorces a wife for whom the waiting period has been established?

General Chapter

Book of the Oath of Abstention (Ila')

Book 41 · Issue 3 · Bab 1

Open in Qurani

Primary text

If the husband establishes the waiting period for the first wife, divorces her, and then establishes the waiting period for the second, and divorces her, and so on until the last, the procedure continues. Likewise, if one of the wives dies, it does not prevent him from establishing the waiting period for the remaining wives because his oath has not been broken regarding them, and his Ila' remains extant due to his lack of intercourse with them.

Supporting text

According to the opinion of Al-Qadi and those who agree with him, if he has intercourse with one wife (either during the established waiting period or before), his oath is dissolved, and the ruling of Ila' ceases for the remaining wives, similar to the ruling if he divorces the wife for whom the waiting period was established.
