If a husband says, "If I have intercourse with you, then by God, I will not enter the house," he is not considered to have established *Ila'* from the beginning. If he engages in intercourse, the *Ila'* is dissolved because he remains prohibited from entering the house by the oath, but not prohibited from intercourse itself. The primary reasoning is that his oath is conditional, so before the condition is met, he is not bound by an oath, and thus not one who has established *Ila'*. Furthermore, he can engage in intercourse without violating the oath, so he is not legally prevented from intercourse.
