Primary text

An oath stating, "By Allah, I will not approach you except with your consent" does not constitute Ila'. This is because the husband retains the possibility of intercourse without breaking his oath. Furthermore, he is considered a benefactor by obligating himself to avoid her displeasure. This ruling applies similarly to oaths stating, "By Allah, I will not approach you while you are coerced (mukraha)" or "while you are sad (mahzuna)", as intercourse remains possible without breaking the oath.
