What phrases require a specific intention (*niyyah*) of non-consummation to establish *Ila'*?
General Chapter
Al-Mughni
Book of the Oath of Abstention (Ila')
Primary text
Any phrase that can potentially imply sexual intercourse but is not explicitly mentioned above requires the intention of non-consummation to constitute *Ila'*. Examples include: 'By Allah, my head will not meet your head,' 'I will cause you grief,' 'I will anger you,' or 'My absence from you will be long.' If the intent was to abstain from intercourse for the prescribed duration and this is acknowledged, *Ila'* is established; otherwise, it is not, as these phrases lack the clear indication of the previous categories.
Supporting text
Some ambiguous phrases specifically require both the intention of non-consummation AND the intention to limit the abstinence to a period exceeding four months: 'I will cause you grief' (*li-ughidhannaki*), 'I will anger you' (*li-aghyidhannaki*), and 'My absence from you will be long' (*li-tatoolanna ghyibati anki*). For all other ambiguous phrases, the intention of non-consummation alone is sufficient. If one says, 'By Allah, I will lengthen my abandonment of intercourse with you,' this is explicit regarding the abandonment of intercourse, and only the intention of the duration is considered. If one swears, 'By Allah, I will not have intercourse with you except weak intercourse,' it is not *Ila'* unless the intent was intercourse that does not involve the meeting of the circumcised parts.
