Does the ruling of Ila' revive if a condition imposed on the wife is met after the dissolution of marriage?
General Chapter
Al-Mughni
Book of the Oath of Abstention (Ila')
Primary text
If a husband says to his wife, 'If you enter the house, by Allah, I will not have intercourse with you,' and then divorces her, and she marries another man, and then the first husband marries her again, the ruling of Ila' revives. This is because the condition established during the marriage contract is not dissolved by the termination of the marriage. However, if she entered the house during the period of separation (baynunah), and he subsequently married her, the ruling of Ila' is not established because the condition was met while she was a non-wife (ajnabiyyah), and Ila' cannot be established by swearing regarding a non-wife. This is contrasted with the case where she entered the house while she was his wife.
