What is the ruling regarding the dissolution of Ilaa' (oath of abstinence) if the oath-taker performs Kaffarah (expiation) before the stipulated period?
General Chapter
Al-Mughni
Book of the Oath of Abstention (Ila')
Primary text
If a man swears an oath of Ilaa' to abstain from intercourse for a year, and subsequently performs the Kaffarah for his oath, the Ilaa' is dissolved immediately upon the expiation. This ruling applies whether the expiation occurs before the four-month statutory period or after it, as the oath itself is nullified by the expiation. This is analogous to one who swears an oath and adds an exception (*istithna'*). If the Kaffarah is made before the four months pass, the Ilaa' dissolves at the time of expiation, treating the situation as if he had sworn to abstain for less than four months. This view is attributed to Abu Abdullah (Ahmad ibn Hanbal) as reported by Al-Athram.
