Does forgiving a debt break an oath sworn against giving a gift?
General Chapter
Al-Mughni
Book of Oaths
Primary text
If a person swears not to give a gift and subsequently forgives a debt owed by the person, the oath is not broken unless that specific intention (*nīyya*) was present. This is because a gift, in this context, is the transfer of ownership of a tangible object, and a debt is merely a claim against the debtor's obligation.
