Primary text

If a person swears not to give obligatory charity to someone, and subsequently gives that person a gift, the oath is not broken. This is because charity is a specific type of gift, and an oath sworn against a specific type does not encompass the act of another type. Evidence is that charity was forbidden to the Prophet (PBUH), while gifts were not.
