Is the statement 'Laha Allah' (By God) considered a valid oath if the speaker intends it as such?
General Chapter
Al-Mughni
Book of Oaths
Primary text
The statement 'Laha Allah' when accompanied by the intention of an oath constitutes a valid oath. This is supported by the report concerning Abu Bakr As-Siddiq, peace be upon him, regarding the spoils of Abu Qatada, to which the Messenger of Allah, peace and blessings be upon him, confirmed its truthfulness. If the speaker does not intend the oath, it is not considered an oath because it lacks conventional context, intention, or any particle indicating an oath in its response.
