Is an agent's statement concerning profit or loss accepted?
General Chapter
Al-Mughni
Book of Partnership
Primary text
The statement of an agent who says, 'I profited one thousand,' and then retracts by saying, 'I lost that amount,' is accepted. This acceptance is based on the agent being considered a trustee, whose statement regarding loss is accepted, similar to an agent (wakil).
Supporting text
If the agent claims 'I was mistaken' or 'I forgot,' the statement is not accepted because this constitutes an admission of a right belonging to another person (a human right), and retraction from such an admission is not accepted, analogous to retracting an admission that the principal capital was a thousand.
