What is the liability of the Mudarib if he neglects pursuing stolen or usurped capital when the capital owner is present?

If the capital owner is present and aware of the situation regarding the stolen or usurped capital, the working partner (Agent/Amil) is not required to pursue its recovery, nor is he liable for it if he neglects to do so, because the capital owner has a greater right to pursue the matter than his agent.
