General Chapter
Al-Mughni
Book of Partnership
Primary text
The preferred view is that the partner possesses the right of Iqala. If Iqala is considered a sale, the partner has the right to sell. If it is considered a termination (faskh), the partner possesses the right to terminate due to a defect when it serves their interest; likewise, they possess the right to terminate via Iqala when it is advantageous, as they might have purchased something where they were disadvantaged.
Supporting text
It is possible that the partner does not possess this right if Iqala is deemed a termination, because termination is not considered part of trade.
