Is a purchase of a wife by the capital provider (Rabb al-Mal) valid?
General Chapter
Al-Mughni
Book of Partnership
Primary text
The purchase of a wife by the provider of the capital is valid, and the marriage contract is consequently annulled. This applies whether the purchase is made using funds held in trust or the specific capital assets themselves. The basis for validation is that what was purchased is something from which profit can be sought, making it permissible, similar to purchasing a non-mahram person.
