If one partner in a partnership dies and leaves a legally competent heir, that heir has the option to continue the partnership, and the remaining partner must permit them to act within the partnership. Alternatively, the heir has the right to demand partition of the assets. If the heir is legally incapacitated (under guardianship), their legal guardian stands in their place, acting only in what serves the best interest of the ward.
