What is the working partner's right to compensation if he voluntarily performs tasks not required of him?
General Chapter
Al-Mughni
Book of Partnership
Primary text
If the working partner voluntarily performs a task he is not obligated to do, he has no right to a wage for it. If he performs it with the intention of receiving a wage, he still receives nothing, which is the explicit ruling from Imam Ahmad. The correct position holds that he receives nothing in either case because he performed an action on another's property for which no compensation was designated, thus he deserves nothing, similar to a non-partner (Ajnabi).
Supporting text
Some associates derived an alternative view suggesting he is entitled to a wage, based on whether a partner who undertakes unrequired work in a general partnership is entitled to compensation, a matter for which there are two narrations. This situation is analogous to that.
