Is circumcision required for a mortgaged slave?
General Chapter
Al-Mughni
Book of Pledges (Collateral)
Primary text
Circumcision is required for a slave that is mortgaged. If the debt is due or postponed until after the slave's healing, the owner must perform the circumcision. This is permitted because it increases the slave's value, it is an obligation, and it does not harm the mortgagee, with the cost falling upon the mortgagor (Rahn).
Supporting text
If the debt is due after healing and the time is moderate without fear of harm, the circumcision is allowed.
