Is the mortgagor compelled to breed mortgaged livestock?
General Chapter
Al-Mughni
Book of Pledges (Collateral)
Primary text
The mortgagor is not compelled to bring a stud for breeding if the mortgaged livestock requires it. This is because maintaining the livestock does not constitute an increase to the mortgage itself, nor is it strictly necessary for the continued existence of the livestock, and preventing it causes no harm to the mortgagee. However, if the livestock requires a herdsman for grazing, the mortgagor must appoint one, as this is considered equivalent to providing fodder.
