What occurs if the pledgor revokes permission to sell before the sale, and the pledgee sells after learning of the revocation?
General Chapter
Al-Mughni
Book of Pledges (Collateral)
Primary text
If the pledgor authorizes the sale and subsequently revokes that authorization before the sale takes place, and the pledgee sells the item after becoming aware of the revocation, the sale is invalid. Al-Shafi'i holds this position.
Supporting text
If the pledgee sells after the revocation but before knowledge of it spreads, there are two possibilities, analogous to whether the dismissal of an agent is effective before the agent is informed.
