Is the owner liable for the destruction of an animal given permission to strike?
General Chapter
Al-Mughni
Book of Pledges (Collateral)
Primary text
There is no liability upon the person who strikes an animal if it perishes, provided the striking was done with the permission of the owner. This is because the destruction is a direct consequence (*tawallud*) of the permitted act. This situation is analogous to the offspring resulting from permissible sexual intercourse.
