Whose statement is accepted when the owner claims to have sold the slave for a thousand, but the claimant says he held it as collateral for that amount?
General Chapter
Al-Mughni
Book of Pledges (Collateral)
Primary text
The statement of each party regarding the contract they deny is accepted. Consequently, the owner takes back his slave. This principle applies similarly if the claimant says, 'I mortgaged it to you for a thousand for a loan,' and the owner replies, 'Rather, I sold it to you for a thousand and I received it as the price.'
Supporting text
The claimant must return the thousand (currency/value) to the owner to reclaim the slave.
