Is the Adhan for Fajr permissible before the beginning of its legal time?

The Adhan for the Fajr prayer is permissible after midnight. This is the position held by Al-Shafi'i and some of our companions. The legal justification is that doing so concludes the preferred time for the Isha prayer and marks the entry of the time for departing from Muzdalifah, the time for the Jamra stoning, and the time for Tawaf Al-Ziyarah. Evidence for this is provided by a narration from Al-Athram, on the authority of Jabir, stating that the caller to prayer at the mosque of Damascus would call the Adhan for the dawn prayer in the late hours of the night (Sahar) with enough time for a rider to travel six miles, and neither Mak'hul nor others objected to this practice.
