Does attaching the intention to stay (residence) to a condition invalidate the legal status of travel (safar)?
Chapter on the Traveler's Prayer
Al-Mughni
Book of Prayer
Primary text
The legal status of travel remains valid when a traveler states, "If I meet so-and-so, I will stay, and if I do not meet him, I will not stay." This is because the traveler has not decisively committed to residence. The decisive commitment to residence, which invalidates the travel status, has not occurred; rather, the matter is suspended upon a condition. Furthermore, suspending the intention upon a condition is not forbidden (haram).
