Must one be praying behind the Imam of the locality (Imam al-Hayy) to repeat a prayer in congregation during a prohibited time?

The view of Al-Kharqi implies that the repetition is permissible regardless of whether the congregation is led by the Imam of the locality or another leader, and whether the initial prayer was performed alone or in congregation. The statements of Ahmad also indicate this generality. The evidence is general, indicating repetition whether with the Imam of the locality or not, and whether prayed alone or in congregation. Narrations support this, such as when Abu Musa led the Fajr prayer, and upon arriving at the main mosque, the congregation was praying, so they prayed with al-Mughirah ibn Shu'bah.
