Recitation of the Surah along with Al-Fatiha by the follower during the appropriate places in the silent prayer is legislated (Sunnah). The general ruling, when not reciting aloud, is that the follower should recite. This is supported by the Hadith indicating that the general command for recitation applies unless specifically restricted, and restriction only occurs during the Imam's loud recitation.

Abu Salama ibn Abd al-Rahman indicated that the Imam has two pauses, during which the follower should seize the opportunity to recite Al-Fatiha: when he begins the prayer and when he says 'nor of those who go astray.' 'Urwah ibn Al-Zubayr stated he utilizes two instances: when the Imam finishes the verse 'nor of those who go astray,' and when he finishes the Surah before bowing.
