If the travel was permissible, then the traveler intended sin, and thereafter returned to the intention of permissible travel, the distance required for shortening prayers is calculated starting from the moment the intention reverted to permissibility. This is because the legal status of the travel was interrupted by the intention of sin, making it analogous to a situation where a traveler intended to reside (stay) and then resumed the intention to travel.
