The effect of a seller's admission of sale when the buyer denies the purchase and holds the property.

If the seller admits to the sale, yet the buyer who possesses the property denies having purchased it, the admission is not binding. This is because the person currently holding the property is implicitly acknowledging the pre-emptor's right to it, having no other contender. In contrast to this scenario, when the seller admits the sale but holds nothing themselves, and the buyer denies the purchase while claiming ownership, the seller cannot effect the transfer of the share, thus distinguishing the cases.
