The saying of the Prophet, peace be upon him, 'Whoever has a portion (shiqs) in the land, or a wall, it is not lawful for him to sell until he seeks permission from his partner; if he wishes, he takes it, and if he wishes, he leaves it,' may imply an obligation to offer it for purchase so that the partner may acquire it if he desires, thus easing the burden, and allowing the buyer's purchase to stand, without necessarily constituting a definitive waiver of the preemption right itself.
