If ownership were established merely by demanding it, then the right of preemption would not lapse if the pre-emptor pardons (*'afw*) the right after the demand. Furthermore, if there were two pre-emptors who both demanded their right, and one subsequently relinquishes their claim, the other would only be entitled to take their own share, not the share of their companion, which indicates that mere demand does not establish ownership.
