The right of preemption is not established for the extremist innovator, such as one who believes Gabriel erred in the message and that it should have been sent to Ali instead of the Prophet, peace be upon him. This ruling is based on the principle that if preemption is not established for the dhimmi (non-Muslim citizen) who affirms his state of disbelief, then those who hold such extremist views are excluded first.
