If the informer is someone whose statement is not legally acted upon, such as a transgressor (Fasiq) or a minor (Sabiyy), the right of preemption is not voided. This is because the report is not one that is accepted in Islamic law for establishing rights, resembling the statement of a child or someone insane.

A narration is reported from Abu Yusuf that the right is forfeited because the statement is one accepted in the Shari'ah for matters like granting permission to enter a house, similar to the testimony of a just person.
