Is it forbidden to possess utensils made of gold and silver?

Chapter on Utensils

Al-Mughni

Book of Purification

Book 2 · Issue 1 · Bab 3

Open in Qurani

Primary text

Possession of utensils made of gold and silver is forbidden. This is because anything whose use is prohibited absolutely is also prohibited from being possessed in the form intended for use, similar to the forbidden musical instrument (al-tanbur). The prohibition on using gold and silver utensils applies absolutely in drinking, eating, and similar acts, as the textual evidence prohibits drinking and eating, and other similar acts fall under the same ruling. This prohibition applies equally to men and women due to the generality of the text concerning both genders and the presence of the reason for prohibition in their cases.

Supporting text

It is reported from Al-Shafi'i that possessing them is not forbidden, because the religious text regarding the prohibition was specifically about their use, not their possession, analogous to a man possessing silk garments.
