Is a major ablution (Ghusl) obligatory upon an insane person or one who fainted upon regaining consciousness without a wet dream?
Chapter on What Necessitates Ghusl
Al-Mughni
Book of Purification
Primary text
Major ablution is not obligatory upon an insane person or one who fainted upon regaining consciousness if no seminal emission occurred. There is no known disagreement on this ruling. Evidence supporting this includes the consensus of scholars, as reported by Ibn al-Mundhir, and the deduction that the loss of intellect itself does not necessitate Ghusl, nor should certainty be abandoned based on doubt regarding emission. If emission is confirmed in such cases, Ghusl becomes obligatory as it is then considered an ejaculation resulting from a wet dream, falling under the established obligations. However, performing Ghusl in these cases is recommended due to the practice of the Prophet (peace be upon him) and as a means of exiting potential scholarly difference of opinion.
