If water is found at a location, it belongs to the living individuals because the deceased has no need for anything. If the water belonged to the deceased and a surplus remains after the needs of the living are met, the surplus belongs to the deceased's heirs. If no heir is present, a living person may take the surplus by paying its value because leaving it constitutes waste.

Some scholars hold that the living person cannot take the surplus without permission unless they are in dire need due to thirst, in which case they may take it under the condition of guarantee (liability for payment).
