What is the ruling on water heated with impurity when physical contact is unconfirmed and the barrier is unsound?

If the arrival of any part of the impurity into the water is not confirmed and the barrier between the impurity source and the water is unsound, the water remains on its original state of purity. However, using this water is disliked (Makruh). This is because the water is in a state suspended between purity and impurity while the cause of impurity is present, thus its least permissible state is dislike. The alleged narration that the Prophet, peace be upon him, entered a bathhouse in Al-Juhfah is not firmly established, and even if it were, it is a specific instance (Qadiyya fi 'Ayn) and does not establish the negation of dislike generally.

Al-Shafi'i holds that using such water is not disliked because the Prophet, peace be upon him, entered a bathhouse in Al-Juhfah. Furthermore, it is argued that the fuel source was not established as impure, nor was the barrier established as unsound in that narration.
