Does touching the male organ nullify Wudu?
Chapter on What Nullifies Purification
Al-Mughni
Book of Purification
Primary text
There are two established narrations from Imam Ahmad regarding touching the male organ. The majority opinion states that touching the male organ nullifies Wudu. This view is supported by Ibn 'Umar, Sa'id ibn al-Musayyab, 'Ata', Aban ibn 'Uthman, 'Urwah, Sulayman ibn Yasar, Al-Zuhri, Al-Awza'i, Al-Shafi'i, and is the famous position of Malik. Evidence supporting nullification includes the authentic Hadith from Busrah bint Safwan that the Prophet, peace be upon him, said: "Whoever touches his male organ should perform Wudu." Similar reports are found from Jabir and Umm Habibah. Scholars deem the Hadiths of Busrah and Umm Habibah to be authentic.
Supporting text
The second narration states that touching the male organ does not nullify Wudu. This position is attributed to 'Ali, 'Ammar, Ibn Mas'ud, Hudhayfah, 'Imran ibn Husayn, Abu al-Darda', Rabi'ah, Al-Thawri, Ibn al-Mundhir, and the 'Ashab al-Ra'y. Their primary evidence is the Hadith narrated by Qays ibn Talq from his father, stating that when asked about touching one's male organ after Wudu, the Prophet, peace be upon him, replied: "Is it anything but a piece of flesh from you?" This narration is considered weaker, and the majority argues that their evidence (the command to perform Wudu) is later in time and thus abrogates the opposing report, and comparison to touching other body parts is invalid due to unique rulings associated with the organ.
