What is the ruling regarding a prize (*sabaq*) provided by one of two leaders of competing groups (*hizbayn*)?
General Chapter
Al-Mughni
Book of Racing and Archery
Primary text
If one of the two leaders provides the prize from his own wealth and his party wins, nothing is due from his party because he stipulated it upon himself and not them. If he stipulated it upon them, then it is incumbent upon them equally, and it goes to the other party equally, whether or not all members of that other party were successful. This is based on the precedent set by the stipulation upon the first party.
Supporting text
In an alternative ruling concerning the distribution to the winning party, the prize is divided among them according to the extent of their success. Those who did not achieve success receive nothing, as their entitlement is contingent upon success, thus making the share proportional to their achievement. This contrasts with the situation of those who initially committed to paying a prize, as payment was obligatory upon them due to their commitment, and they were equal in that obligation.
