Primary text

Private seclusion (Khalwa) with the divorced woman does not constitute revocation because it is not considered enjoyment (istimta'). This is the chosen position of Abu al-Khattab.

Supporting text

It has been narrated from others among our companions that revocation occurs through khalwa because it is an act forbidden with a non-mahram woman (ajnabiyya) but permissible with one's wife, thereby establishing revocation analogous to other forms of enjoyment.
